GDPR and Cesar

The GDPR, effective May 25, 2018, strengthens the 1978 Data Protection Act. Its aim is to enhance control over personal data and privacy for all EU citizens. It applies to all European companies, which must update their data processing policies and inform users accordingly.

Cesar collects and processes personal data to provide quality services. This includes information submitted via:

 -Website contact forms

 – Phone conversations

 -Emails

 -In-person meetings

All data is collected with user consent and used solely for delivering tailored services or quotes.

Collected Data and Purpose

Personal data may include:

Additional data may be requested to offer personalized recommendations. Cesar limits data collection to what is strictly necessary for service quality.

Data Controller and Access

Cesar, located at 2 bis, rue Albert Dammouse, 92310 Sèvres (📧contact@cesar.team / +33 (0)1 45 07 14 14), is the data controller. Data is securely stored and encrypted (SSL certificate).

Data Retention Period

Personal data is kept for a maximum of 10 years, depending on the service.

Retention period for personal data

Every customer has the right to be forgotten, which limits the length of time data can be kept and prevents it from being held by the data controller ad vitam æternam.

Cesar undertakes to keep its customers’ personal data for a maximum of 10 years, depending on the product for which you are requesting our services.

Users’ Rights Regarding Their Personal Data

Thanks to the GDPR, users benefit from enhanced rights and new rights. As a European user who provides personal data to a company, here is what the GDPR strengthens or establishes:

The Right to Information

Users have the right to be informed whenever their data is collected, even if it was obtained from a third party. Regarding intrusive cookies (trackers), user consent must also be obtained after clearly and unambiguously informing them that cookies will be stored on their device, notably via a “cookie banner.” The website must offer the user the option to click a button or check a box to give consent and to click a button linking to a page with more information about cookies.

Consent

Users have the right to be informed about the collection of their data and must give their consent or be able to object to its processing. Consent must be given explicitly and positively. Users also have the right to withdraw their consent at any time without affecting the lawfulness of the processing based on consent before its withdrawal. Users can also withdraw consent regarding the placement of each cookie.

Protection of Minors Under 16

Users under 16 must have access to clear and simple information about the processing of their data so they can easily understand it. Consent must be obtained from the holder of parental authority, notably the parents. Once of legal age, the user will have the right to request withdrawal of consent and deletion of their data.

Right to Object

Users have the right to refuse data processing or to object to marketing use of their data at any time.

Right to Restrict Processing

Users have the right to request the restriction of their data processing, thereby forcing the company to store their data without using it. This right applies to unlawful processing and/or inaccurate information.

Right of Access

Users have the right to easily access their data. They must receive confirmation on whether their data is being processed and be provided with a copy of their data.

Right to Data Portability

Users have the right to obtain the personal data they provided to a company in a format that is easy to reuse, notably to transfer it to a third party.

Right to Rectification

Users can request to complete or correct their data.

Right to Be Forgotten

Users have the right to obtain the deletion of their personal data (withdrawal of consent, no justification, opposition to processing, etc.). They may request that a link be de-indexed from a search engine or that information be deleted if it infringes on their privacy.

Data Protection

Users must benefit from protection of their personal data by the data controller from the design of the product or service and by default.

Right to Communication

Users have the right to be informed by the data controller if there has been a breach of their personal data

Breach Notification

Users must be alerted by a company in the event of a security breach within 72 hours.

Transparency

Users must have access to clear, intelligible, and unambiguous information on data processing. This information must be understandable and accessible to everyone so that they can more easily exercise their rights.

Exercising Your Rights

Every user must know their rights, as well as when and how to assert them.

Every company must respect users’ rights. However, when one of the rights mentioned above is not respected by a European company processing personal data of an internet user, the user has the right to claim that their rights have not been respected by that company.

If a company does not respect all the users’ rights regarding the collection, processing, transfer, protection, and storage of their personal data, users:

 – may contact a single point of access: the user has the right to file a complaint with a supervisory authority, the data protection authority of their country, regardless of the location of the company processing their data.

–  have the right to seek compensation for material or moral damage: anyone who has suffered material or moral damage due to a GDPR violation has the right to obtain compensation for the harm suffered from the data controller or processor.

– may have the responsible company sanctioned: in case of violation of users’ rights, penalties are increased. The responsible company may face a fine of up to 4% of its global turnover.

An intuitive interface designed for everyone : from team members to executive committees

CESAR is a cloud-based collaborative platform for managing your company’s projects.
